National courts play a pivotal role in making EC law a living truth for citizens. Individuals may turn to the courts in order to invoke rights derived from Community law. However, the capacity of individuals to effectively enforce their Community law rights depends crucially on the correct application of Community law by national courts. This book is the first to deal with possible legal responses in the Community legal order and beyond, when national courts incorrectly apply Community law. Rooted in a rigorous contextual analysis of recent jurisprudence, this work discusses various alternatives for future developments in the Court´s case law. The author explains the often uneasy nature of the relationship between national courts and the ECJ. He explores common concerns voiced against an excessive degree of accountability for judicial conduct.

Differentiation was at first not perceived as a threat to the European project, but rather as a tool to promote further integration. Today, more EU policies than ever are marked by concentric circles of integration and a lack of uniform application. Les notions indéterminées sont multiples en droit communautaire. Parmi elles, certaines, dont l’incomplétude est délibérée, permettent une appréciation des comportements et des situations en termes de normalité et nécessitent pour leur application des références exogènes au droit. Il s’agit des standards juridiques. Après avoir consacré des développements approfondis à l’identification précise de la notion de standard, l’auteur s’interroge sur les raisons de leur emploi fréquent en droit communautaire et s’attache à rechercher leur spécificité par rapport aux standards relevant d’autres droits. Une analyse des standards selon leur degré d’imprégnation communautaire conduit à constater que, du point de vue de leur substance, leur spécificité n’est que partielle. Du point de vue de leur fonction, en revanche, cette spécificité est très marquée, eu égard aux particularités de l’ordre juridique communautaire, et notamment au rôle du juge qui doit donner un contenu aux standards lors de l’interprétation et de l’application des normes qui les contiennent. De plus, le standard facilite, en raison de son indétermination, l’élaboration non seulement d’une règle flexible particulièrement adaptée à la matière économique qui caractérise encore largement le système communautaire, mais aussi d’une règle commune qui pourra être appliquée de manière différenciée sur le territoire de tous les États membres. Enfin, parce qu’il favorise une distribution souple des pouvoirs et des compétences entre autorités communautaires et nationales, le standard apparaît comme un instrument nécessaire à l’articulation des différents ordres juridiques. Cet ouvrage est ainsi susceptible de retenir l’attention, non seulement des spécialistes du droit de l’Union européenne, mais aussi, plus largement, de ceux qui s’intéressent à la théorie de l’interprétation et de la structuration des ordres juridiques

Notre droit s'internationalise, s'européanise, dans un mouvement exponentiel. Outre les oppositions idéologiques à ce phénomène, que l'on peut juger stériles et surtout très peu conformes à la réalité, les difficultés juridiques suscitées par l'interpénétration des ordres juridiques peuvent décontenancer, tant les instruments habituels de gestion des conflits normatifs sont peu adaptés au traitement des conflits entre norme interne et norme internationale. Le juge, la doctrine ne parviennent pas vraiment à trancher le noeud gordien que constituent ces rapports. Les atermoiements, les silences, les retours en arrière, les crispations démontrent à quel point les cartes sont redistribuées et les enjeux à la mesure des bouleversements. - Les drames, les batailles mêmes que suscitent certaines évolutions du droit, comme le caractère prioritaire de la question de constitutionnalité, démontrent que l'édifice est fragile. Les rapports entre ordres juridiques ne peuvent être compris et solutionnés en mobilisant des grilles de lecture qui relèvent avant tout d'une logique d'ordre juridique interne. Il convient de repenser ces rapports, de réfléchir avec d'autres prismes, d'abandonner des instruments qui paraissaient incontournables comme la hiérarchie des normes, de porter d'autres regards, de chercher des voies nouvelles de traitement des conflits entre normes externes et normes internes. La doctrine doit aussi être capable de porter un regard sur elle- même quant à sa vision des rapports entre ordres juridiques, quant à son obédience à certains postulats. Porter un autre regard sur les rapports entre ordres juridiques, telle est l'ambition de cet ouvrage.
